Continuous Vetting and Threat Analysis Terms & Conditions

In addition to the Terms set forth in the DigitalStakeout Master Subscription Agreement, the following specific terms and conditions apply to DigitalStakeout's Continuous Vetting and Threat Analysis Service ("Service").

No Warranty or Guarantees

1. Identity Match
   DigitalStakeout does not warrant that a person “identity” can or will be matched accurately to a social media identity or any other online identity. We also cannot guarantee the accuracy of the match. 

2. Source Specificity
   DigitalStakeout does not warrant any particular data source (i.e., social media network) will be supported. DigitalStakeout will take reasonable efforts to maximize coverage capabilities.

3. Data Collection
   DigitalStakeout does not warrant any data can be collected from a public profile. DigitalStakeout will take reasonable and legal efforts to acquire data from a public profile.

4. Spotting
   DigitalStakeout does not warrant the accuracy or recall quality of a any category. In the event of a false positive or false negative, DigitalStakeout will take reasonable efforts to update our processes to improve spotting capabilities.

 

Usage Restrictions

1. Civil Rights: YOU agree not to use the data obtained through the Service in any manner that infringes upon any individual's human or civil rights.

2. Opt-In Only: YOU may only use the Service on individuals who have explicitly opted into a review/screening of their online presence.

3. Compliance: You must maintain compliance with the Fair Credit Reporting Act (FCRA), Equal Employment Opportunity Commission (EEOC) regulations and any other applicable federal, state or local laws or regulations.
    

Data Privacy and Protection

YOU will use the Service in compliance with Fair Credit Reporting Act (FCRA) and other applicable federal, state laws and regulations. YOU will ensure compliance with any federal or state-specific laws governing social media screening. YOU will ensure compliance against discrimination based on protected categories as guided by the Equal Employment Opportunity Commission (EEOC).

 

Proprietary Data Rights

• Restrictions on Use

  • YOU acknowledge and agree that any asset data, metrics, content, alerts, and reports provided by the Service is proprietary to DigitalStakeout. You are expressly prohibited from, and shall not, directly or indirectly, engage in, assist, or permit any third party to engage in any the creation of any service bureau, data store, reverse engineering, decompilation, disassembly, or any other form of derivation of the data, metrics, content, alerts, and reports and any underlying algorithms, methodologies, and processes used in the generation of the Service.

• No Implied License

  • Unless explicitly defined in a License Agreement, nothing in these Terms shall be interpreted as granting, by implication, estoppel, or otherwise, any license or right to use the data, alerts, and reports in any manner that involves the creation of any service bureau, data store, reverse engineering, decompilation, disassembly, or any other form of derivation of the data, metrics, content, alerts, and reports and any underlying algorithms, methodologies, and processes used in the generation of the Service.

• Enforcement

  • Any violation of these Terms will be considered a material breach of this Agreement. DigitalStakeout reserves the right to take appropriate legal action, including seeking injunctive relief, damages, and any other remedies available under law or equity, against You or any third party that violates this prohibition.
